Terms and Conditions (AGB)

1. Scope and contracting party

1.1 These Terms and Conditions apply to all orders of goods via the online shop IQ-Home at iq-home.at (including locale paths /de and /en) between

(hereinafter “we”, “us” or “seller”)

and natural or legal persons (hereinafter “customer”, “you”) who order goods via the online shop.

1.2 A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed. A business customer (entrepreneur) is any natural or legal person or partnership with legal capacity acting in the course of their commercial or self-employed professional activity.

1.3 Deviating, conflicting or supplementary terms of the customer do not become part of the contract unless we expressly agree to them in writing.

1.4 IQ-Home is an authorized LOXONE Silver Partner and independent specialist retailer. IQ-Home is not identical with LOXONE Electronics GmbH and does not act as LOXONE itself. LOXONE is a trademark of LOXONE Electronics GmbH. Product images of LOXONE components: Source LOXONE (per partner guidelines).

2. Subject matter

2.1 The contract concerns the purchase of the goods described in the online shop (in particular LOXONE components and accessories) at the stated prices and terms.

2.2 Product descriptions, images and technical data are for orientation. Manufacturer information (especially from LOXONE) may change; the information shown at the time of order and statutory warranty rights are decisive.

2.3 An empty cart cannot proceed to checkout. Orders require a valid selection of goods in the shopping cart.

3. Conclusion of contract

3.1 Product presentations in the shop are not a binding offer but an invitation for the customer to submit a binding offer.

3.2 By submitting the order in checkout (binding order button), the customer submits a binding offer to purchase the goods in the cart.

3.3 The contract is concluded when we accept the order by order confirmation e-mail or by dispatching the goods. An automatic order receipt acknowledgement is not yet acceptance unless expressly stated otherwise.

3.4 We may refuse orders, in particular in case of obvious pricing errors, unavailability, suspected misuse, or a delivery address outside the countries we ship to.

3.5 Guest checkout or customer account: At checkout, the customer may choose to order as a guest (without a customer account) or with a registered / signed-in customer account. For a guest order, a valid e-mail address is required; no customer account is created. With a customer account, orders can be linked to the account and address data may be pre-filled. These Terms and the privacy policy apply regardless of the chosen path.

4. Prices, taxes and shipping

4.1 All prices shown in the online shop are in euro (gross, incl. VAT), unless expressly marked otherwise. Catalogue prices are based on the supplier’s net prices; the gross display uses the applicable tax rate.

4.2 Shipping and tax:

  • Shipping: Austria EUR 10.00 gross, Germany EUR 15.00 gross (incl. 20 % VAT; net portions Austria EUR 8.33 / Germany EUR 12.50). For DE delivery with a valid VAT ID (0 % VAT), the same amounts remain due as net.
  • VAT: generally 20 % on goods and shipping net amounts; in the shop and at checkout amounts are shown as gross incl. VAT, and VAT is shown at checkout as “of which VAT”

4.3 Deliveries to Austria always include Austrian VAT at 20 %.

4.4 Deliveries to Germany to businesses with a valid VAT ID confirmed via VIES may be invoiced as an intra-EU supply without Austrian VAT (0 %, reverse charge / tax liability of the recipient), if legal requirements are met. In that case the displayed gross amounts equal the net amounts. Without a valid/verified VAT ID, DE deliveries are also charged 20 % VAT.

4.5 The total shown at checkout (gross incl. stated VAT) is binding for that order before submission, subject to obvious errors.

5. Delivery area and delivery terms

5.1 Delivery is made exclusively to Austria (AT) and Germany (DE). Orders with other delivery addresses are not accepted.

5.2 Goods are delivered to the shipping address provided at checkout.

5.3 Dispatch takes place after receipt of prepayment (see section 6). Delivery times may vary depending on availability, manufacturer and carrier. Unless otherwise stated in the shop or order confirmation, we aim to process orders promptly after payment. Binding delivery dates require express confirmation.

5.4 Partial deliveries are permitted if reasonable for the customer and without extra cost, unless the customer has excluded partial deliveries.

5.5 Transfer of risk: For consumers, risk passes when the goods are handed over to the consumer or a recipient designated by them (other than the carrier). For business customers, risk passes upon handover to the carrier, to the extent permitted by law.

6. Payment

6.1 Payment is exclusively by prepayment via SEPA bank transfer. No other payment methods are currently offered.

6.2 The account holder is Patrick Hütter. Bank details: IBAN AT98 3431 2000 0014 4675, BIC RZOOAT2L312, bank Raiffeisenbank Maria Schmolln und St. Johann am Walde. The same details are shown at checkout and in the order confirmation. Please use the stated order number as the payment reference.

6.3 Goods are shipped only after full payment has been received. If payment is not received within a reasonable period (generally 14 days from the order), we may withdraw from the contract and cancel the order.

7. Retention of title

Delivered goods remain our property until full payment of all claims arising from the respective purchase contract. For business customers, retention of title extends to all claims from the ongoing business relationship to the extent permitted by law.

8. Warranty and guarantee

8.1 Statutory warranty rules apply. For consumers, the warranty period for movable goods is generally two years from handover.

8.2 Any manufacturer or brand guarantees (e.g. from LOXONE) are obligations of the respective manufacturer and exist alongside the statutory warranty towards the seller; they do not reduce consumer warranty rights.

8.3 Obvious transport damage should be reported promptly where possible; consumers’ statutory rights remain unaffected.

9. Liability

9.1 We are liable without limitation for injury to life, body or health, for intent or gross negligence, and under the Product Liability Act.

9.2 In cases of slight negligence we are liable only for breach of essential contractual duties and limited to foreseeable, typical damage, to the extent permitted by law. Mandatory consumer protection rules remain unaffected.

9.3 Liability for lost profits, missed savings or indirect damage is excluded except in cases of intent, gross negligence or injury to life, body or health, to the extent permitted by law and subject to mandatory consumer protection rules.

10. Right of withdrawal for consumers (distance selling)

Consumers have a statutory right of withdrawal for distance contracts. Business customers have no FAGG withdrawal right.

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If several goods ordered in one order are delivered separately, or goods are delivered in several consignments or pieces, the period begins on the day on which you or such third party acquire possession of the last good, last consignment or last piece.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us (Patrick Hütter / IQ-Home, Stadtplatz 31, 4950 Altheim, Austria) without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. The deadline is met if you send back the goods before the period of 14 days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or early expiry of the right of withdrawal

Under § 18 FAGG, the right of withdrawal does not apply inter alia to goods made to the customer’s specifications or clearly personalized.

The right of withdrawal expires early for sealed goods which are not suitable for return due to health protection or hygiene reasons if unsealed after delivery, and for sealed audio or video recordings or sealed computer software if the seal was removed after delivery (§ 18 (1) FAGG). Other statutory exceptions remain unaffected. No further exclusions are created beyond the law.

11. Returns outside withdrawal

Returns or exchanges outside the statutory withdrawal or warranty rights require our prior consent. Unsolicited cash-on-delivery returns may be refused.

13. Dispute resolution / ODR platform

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. Our e-mail address is office@iq-home.at.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Applicable law and venue

14.1 Austrian law applies, excluding conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers resident in the EU, mandatory consumer protection rules of their country of residence remain unaffected where they provide higher protection.

14.2 For disputes with business customers, the place of jurisdiction is the seller’s seat (Altheim / competent local court). For consumers, statutory venue rules apply; consumers may in particular also sue at their place of residence where provided by law.

15. Severability

If any provision of these Terms is or becomes wholly or partly invalid or unenforceable, the remaining provisions remain in effect. The invalid provision shall be replaced by the legally permissible rule that comes closest to the economic purpose.

16. Notice

These Terms are based on publicly available WKO guidance for distance/online trade and the statutory model withdrawal instructions (FAGG). They are not a substitute for individual legal advice.
